AMENDMENTS TO THE LABOUR CODE IN RELATION WITH THE INTRODUCTION OF DISTANT WORK LEGISLATION
An Act on the Amendment and Supplementation to the Labour Code (AASLC) was promulgated in State Gazette issue 82 of 21 October 2011 with which a legislation regarding the distant work in Bulgaria is introduced. The Act enters into force as from 25 October 2011.
The Act is adopted in relation with the necessity of taking the measures required for the application of the European Frame Agreement for Distant Work, signed in 2002. The legislation is entirely prepared on the basis of the agreements, reached by the representative organizations of the workers and employees and those of the employers and reflected in the National Agreement for the Organization and Application of Distant Work in the Republic of Bulgaria (signed on 24 November 2010).
The mass usage of the means of informational and communication technologies upon performance of work makes the distant form of work a flexible form of employment that is particularly appropriate for a large range of activities and professions in the field of accounting, informational service, medias, insurances, consultant activity, scientific service, software development, etc.
The distant work legislation is introduced by creating a new section in LC – VIIIb “Additional conditions for performance of distant work” in Chapter V “Formation and modification of employment relationship”.
